Terms and Conditions for SWFL Auctions & Liquidations, LLC

There is a 13% Buyer's Premium added to all purchases, with a 3% discount given for paying with cash or check. The accepted forms of payment are Cash, Check, Visa, MasterCard, Discover, and American Express. Buyers are also required to pay a 7% Sales Tax on all purchases. If you have a valid Tax Exempt form you must bring that with you at the time of pickup so that it can be placed with your invoice and filed and then tax will be removed. If you want your items shipped you will also be responsible for any shipping charges. Please bid accordingly.

The highest bidder acknowledged at the end of the auction is the winning bidder and will receive an invoice by email only. If you feel you won and item and did not receive an email please notify us at the office by phone or email on the next business day after the close of the auction.

All items are to be removed from the premises on the scheduled pick up date. The date, time, and location of pick up will be shown on your invoice as well as on the auction site online. Please make arrangements for pick up during those times. Removal of all items shall be at the expense, risk, and liability of the purchaser. If someone else will be picking up for you please contact us so that we can arrange payment, all payments must be made prior to items being picked up. Loading assistance is available when time permits but you should bring a helper if you are purchasing larger, heavier items. Please bring boxes or totes to pickup for multiple purchases and bring packing material for breakable or fragile items.

Again, all items MUST be picked up during the scheduled pick up time. Please make arrangements with our staff before pick up if you can not make it during scheduled hours. All buyers are to pay for the items they won in the auction before the close of the scheduled pick up time. If items are not picked up buyer is still responsible for the invoice and items will be forfeited and relisted in the next auction. Failure to pay for items in a timely manner will result in the buyer losing bidding privileges.

In the event an item is not available at pick up the buyer must notify staff and file a claim by replying to the original invoice within 24 hours of the scheduled pick up. After 24 hours the buyer and the auctioneer agree that no refund will be made.

In the event of a bidding error you MUST notify our office by email by using the Contact Us page on our website BEFORE the close of the auction. Be aware that bidders routinely increase their own bids to price an item out of reach of other bidders. To increase you bid on an item that you are already the high bidder complete the maximum bid field only. You should immediately review your bids once submitted. In the event that you mistakenly increase your own bid, place your bidder number in the bid field, or make a typo you must notify us before the close of the auction. We will not reverse bids after the auction has closed. No Exceptions.

If you have been outbid on an item you will be notified via automated email only until the last day of the auction. Starting at Midnight EST the night before the auction ends notices will not be sent out. Please monitor the bids of the items you wish to purchase on the final day accordingly, many bidders will wait until the very end of the auction to place bids. To quickly review your bids and see if you are the high bidder on an item you can use the 'Review Bids' feature on the auction. Items that you have been outbid on will be clearly marked.

The online auction closes two items every minute starting at the auction end date and time. This feature of closing the auction in intervals allows for bidders to bid on numerous items at the close of an auction like at a live auction. In the event a bid is placed on an item in the closing five minutes of that item the ending time is automatically extended five minutes and will be extended another five minutes whenever a bid is placed thereafter.

In some circumstances equipment in pictures for the auction may be joined together, like a TV with a DVD player. Do not assume that a lot consist of multiple items simply because they are pictured together. Please read the descriptions of all items if you have any questions on exactly what you are bidding on.

You are bidding on the described item. Occasionally the wrong picture can be placed on an item but will be corrected when mistake is noticed.

All items are sold 'AS IS WHERE IS' with no warranty expressed or implied. Descriptions when entered are believed to be honest and accurate but mistakes can be made or imperfections can be overlooked. All bidders are encouraged to attend the preview of the auction during the designated hours to judge condition of items for themselves. Bidders should bid on an item based off of the description and not the photos of the item.

When you bid on the wrong item or decide an item is not suited for your intended use our consignors are not willing to assume the cost of your mistake. When in doubt about condition, suitability, or completeness of an item please bid accordingly.

SWFL Auctions & Liquidations, LLC reserves the right to add or remove items from the auction, split or combine items or 'lots', add minimum bids or reserve prices, cancel, suspend, extend, or reschedule an individual item and/or an auction event. The company also reserves the right to make changes to the auction closing time, the preview or inspection time, and the pick up date and time.

SWFL Auctions & Liquidations, LLC has the option of reselling, removing, storing, items not paid for and picked up after the close of an auction. The buyer of those items agrees to pay all deficiencies, legal, storage, and/or transportation associated with delinquent accounts or abandoned items.

Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Sarasota County Florida. Liability; SWFL Auction & Liquidations, Auctioneer, and sellers liability shall be limited to the refund of bidders purchase price.

The above stated Terms and Conditions of Sale cannot be altered except in writing by SWFL Auctions & Liquidations, LLC.
